The revision of UU ITE and the accountability of social platforms for illegal content

Last week, I submitted recommendations on behalf of PR2Media regarding the regulation of illegal content on social media platforms to the Committee for the Revision of the Electronic Information and Transactions Law (UU ITE) of the Indonesian House of Representatives. The aim is to improve Indonesia’s ability to combat the spread of such content through fair and effective regulations where the fundamental rights of users are protected.

Our proposal focuses on Article 15 of the Law, which addresses the responsibilities of social companies with over 20 million Indonesian users, such as YouTube, Facebook, TikTok, Instagram, Twitter (now X), and LinkedIn, regarding illegal content.

The recommendations are based on our research conducted in early 2023 that included interviews with stakeholders and a survey of 1,500 social media users, as well as the EU’s Digital Services Act and the Santa Clara Principles as references. Our policy paper can be found here.
